全國人民代表大會常務委員會關於批准《內地與香港特別行政區關於在廣深港高鐵西九龍站設立口岸實施“一地兩檢”的合作安排》的決定 (2017年12月27日第十二屆全國人民代表大會常務委員會第三十一次會議通過)
第十二屆全國人民代表大會常務委員會第三十一次會議審議了國務院關於提請審議《關於批准〈內地與香港特別行政區關於在廣深港高鐵西九龍站設立口岸實施“一地兩檢”的合作安排〉的決定(草案)》的議案。全國人民代表大會常務委員會在審議中充分考慮了香港特別行政區和內地各有關方面對廣深港高鐵連接口岸設置及通關查驗模式的意見。
會議認為，建設廣深港高鐵並實現香港特別行政區與全國高鐵網絡的互聯互通，有利於促進香港特別行政區與內地之間的人員往來和經貿活動，有利於深化香港特別行政區與內地的互利合作，有利於香港特別行政區更好地融入國家發展大局，對保持香港特別行政區長期繁榮穩定具有重要意義。為充分發揮高鐵高速高效優勢，使廣大乘客充分享受快捷便利的服務，確保廣深港高鐵香港段的運輸、經濟和社會效益，在廣深港高鐵香港特別行政區西九龍站(以下簡稱西九龍站)實施“一地兩檢”，設立內地口岸區，專門用於高鐵乘客及其隨身物品和行李的通關查驗，是必要的。
會議認為，《合作安排》符合“一國兩制”方針，符合憲法和香港特別行政區基本法。根據憲法，香港特別行政區基本法授權香港特別行政區實行高度自治，包括實行單獨的出入境管理制度等。香港特別行政區政府與內地有關方面就在西九龍站設立口岸並實施“一地兩檢”的相關問題協商作出適當安排，是香港特別行政區依法行使高度自治權的具體體現。在西九龍站設立內地口岸區，不改變香港特別行政區行政區域範圍，不影響香港特別行政區依法享有的高度自治權，不減損香港特別行政區居民依法享有的權利和自由。出於在西九龍站實施“一地兩檢”的需要，《合作安排》對內地和香港特別行政區管轄權(包括司法管轄權)劃分和法律適用作出規定，並...
